Terms of Service

Article 1 (Purpose)

These terms set out the conditions and procedures for using the camera app, its web version, the content portal, ErOS, Ailism Mate, the Ailism account and the company homepage provided under the name Ailism by hjbrain Co., Ltd. (주식회사 에이치제이브레인, the "Company") (together, the "services"), and the rights, obligations and responsibilities of the Company and its users.

Article 2 (Definitions)

• "Ailism" means the name (brand) under which the Company provides the services. In these terms, the party that provides the services and contracts with users is the Company.
• "Services" means every feature the Company provides at ailism.team, in the Ailism camera app (Android, iOS), at photo.ailism.team, at play.ailism.team, at eros.ailism.team and at mate.ailism.team (including Ailism Mate's desktop app and Chrome extension).
• "User" means anyone who uses the services under these terms.
• "Account" means the single Ailism account used to sign in to every Ailism service.
• "ErOS" means the service at eros.ailism.team where you can chat with AI characters, play interactive stories and games, and create and publish your own characters and stories.
• "Ailism Mate" means the service at mate.ailism.team where you can meet Ailism's characters as friends and talk with them, keep them in the bottom-right corner of your screen (on every Ailism site, on websites where the Chrome extension is linked, and in the desktop app), and make and publish your own mates.
• "Characters" and "works" mean the AI characters, stories and games on ErOS that users chat with or play, and their settings, and the AI characters users meet as friends and talk with on Ailism Mate ("mates"), and their settings.
• "User works" means the characters, mates, settings, story text, pictures (uploaded or made with AI) and the like that a user creates in ErOS Studio or in Ailism Mate's Make a mate.
• "Inputs" means the photos, videos and request text a user uploads in the camera app or its web version to make a result.
• "Theme" means a transform style the Company provides (for example, Anime or Action Figure).
• "Result" means a photo or video made by AI from the inputs and a theme.
• "Originals" means works such as webtoons and short series that the Company makes and publishes.

Article 3 (Posting and changing these terms)

The Company posts these terms where they are easy to find in the services.

The Company may change these terms within the limits of the law. When we do, we will announce the changes and their effective date on this page 7 days in advance, or 30 days in advance for changes unfavorable to users.

If you do not agree with the changed terms, you may stop using the services. If you keep using the services after the effective date, you are deemed to agree to the changed terms.

Article 4 (The services and their use)

The services are free; AI features run on the credits your plan gives each day, and you can buy more credits (Article 17-2). The camera app, its web version and browsing the content portal need no account; to post on the content portal, or to chat or create works or mates on ErOS or Ailism Mate, you need to sign in with an account.

In the camera app or its web version, upload a photo or video and pick a theme, and AI makes the result for you.

On ErOS you can chat or message with AI characters, and play simulations on a virtual device and games such as murder mysteries. Anyone signed in can also create and publish their own characters and stories in ErOS Studio.

On Ailism Mate you can meet mates as friends and talk with them, and keep a mate with you in the bottom-right corner of every Ailism site when Keep with me is on, of other websites when the Chrome extension is linked, and of your computer's screen with the desktop app. Signed-up members can also make and publish their own mates in Ailism Mate's Make a mate.

To keep the services stable, the Company may limit the number of uses per device, per period and overall (and, on ErOS and Ailism Mate, per account), and does not process requests over the limit.

The app may be in a pre-release test phase, and themes and features may be added, changed or ended without notice. We will tell users in advance about changes that matter to them.

Article 5 (Age)

You must be 14 or older to create an account, so chatting and creating on ErOS and Ailism Mate and posting on the content portal, which require an account, are not available to children under 14.

For the services that need no account, children under 14 must have the consent of a legal guardian (such as a parent).

Works in ErOS, Ailism Mate (mates) and the content portal carry one of three ratings: all ages, 15+ or 18+ (19세 이용가 in Korean). ErOS and Ailism Mate do not show 15+ works to users under 15.

18+ works and the 18+ rating are hidden by default. Only members who proved they are adults with a Korean mobile identity check on the profile page of the account centre and turned on 18+ content can see and post them; turning it off hides them again. Under the Korean Youth Protection Act you are an adult from January 1 of the year you turn 19.

When you post a work, give it the rating that fits its content. If a rating does not fit, the Company may change it or hide the work (Article 14).

Even in 18+ works, what Articles 12 and 17 forbid (sexual content involving minors, sexual content about real people and the like) and obscene material the law forbids may not be posted. The AI of ErOS and Ailism Mate does not write explicit sexual content even in 18+ works.

Do not verify with someone else's identity or phone. If that comes to light, the Company may cancel the verification and restrict the account.

Article 6 (Ailism account)

One account signs you in to every Ailism service. You can create one on the sign-up page.

When you sign up, you must give accurate information, including your date of birth. Do not sign up with someone else's details or give a false age.

Keep your password safe and do not share it with anyone. If you think someone else is using your account, change your password and tell Ailism.

On the account page you can change your display name, username, language, marketing consent and password. To change your email address or date of birth, email Ailism.

You can delete your account at any time on the account page by entering your password. When you do, your account information and the works, chats and other data made with the account are deleted as described in the Privacy Policy, and this cannot be undone.

Article 7 (Responsibility for inputs)

Upload only inputs you own the rights to or have permission to use.

You may upload photos or videos showing other people only with their consent. If a child under 14 appears, the consent of the child's legal guardian is required.

You allow the Company to store, convert and process your inputs, and to send them to the processors listed in the Privacy Policy, to the extent needed to make and deliver results. How inputs are processed and kept is governed by the Privacy Policy.

The user who uploaded an input is responsible for any problems it causes.

Article 8 (Prohibited conduct)

When using the services, you must not:

• upload photos or videos of other people without their consent, or spread results made from them
• request sexualized or nude depictions of anyone, or any sexualized depiction of a child or teenager
• make or spread results that insult, mock, demean or defame a real person
• deceive others by making it look like a real person did something they did not, or fabricate evidence, identity documents or other documents
• apply violence, self-harm or gore to a real person
• make results that demean people based on race, ethnicity, religion, disability, gender, sexual orientation or similar traits
• infringe anyone's copyright, trademarks, likeness rights or personal data
• send mass requests with automated tools, get around usage limits or request checks, or attack or probe the services in a way that disrupts their normal operation
• otherwise break the law or use the services for crime

In particular, editing a person's face or body into sexually humiliating content, or spreading such content, can be punished under Korea's Act on Special Cases Concerning the Punishment of Sexual Crimes and other laws.

Article 9 (AI results)

Results are made automatically by AI, and the Company makes it known that the services run on generative AI and that results are AI-generated. Results may differ from what you asked for or be inaccurate, may not look like the person in the original, and may vary each time for the same request.

The Company may check requests automatically and refuse those that break these terms, but does not guarantee that the checks catch every problem.

When you show or publish a result where it could be mistaken for a real photo or video, you must say it was made with AI. Do not hide that a result was made with AI or pass it off as real.

Article 10 (Ownership)

The rights to inputs belong to the user (or the original rights holder).

The Company claims no rights to results. You may use results for personal and commercial purposes, as long as you do not break the law or infringe others' rights. Note that AI-made results may not be protected by copyright, and the Company does not warrant that results do not infringe anyone's rights.

The Company does not use your inputs or results for promotion or to train the Company's AI without your separate consent.

The rights to the services, the Ailism name and logo, theme designs and Originals belong to the Company. Originals may not be copied, distributed or modified without the Company's permission.

Article 11 (Keeping results)

Ailism's servers keep inputs and results for 14 days from creation and then delete them; deleted files cannot be recovered. Please save the results you need.

Anyone with a result link can view the result during that period, so take care when sharing links.

Article 12 (ErOS and Ailism Mate)

The characters and stories on ErOS and the mates on Ailism Mate are fiction written by AI. The Company makes it known that ErOS and Ailism Mate run on generative AI and that the replies and stories of characters and mates are AI-generated.

What the AI writes may be untrue, inaccurate or inappropriate. Characters and mates are not real people, and what they say is not professional advice, such as medical, legal, financial or counseling advice.

Your chats on ErOS and Ailism Mate are not shown to other users or to the people who made the characters or mates.

A mate on Ailism Mate remembers things about you from your conversations and, when Talk first is on, messages you first. You can see, edit and forget its memories on the mate's page, and turn Talk first and Keep with me off at any time. Make sure that screens you send with "Show my screen" show no other people's personal information or passwords. How this is processed is set out in the Privacy Policy.

You must not try to make the AI produce:

• sexual content involving minors
• sexual content about real people
• content that encourages self-harm or suicide
• any other content that breaks the law

The Company checks chats automatically to block sexual content involving minors and to show crisis-support contacts when someone expresses thoughts of self-harm or suicide, but does not guarantee that the checks catch every problem.

You can delete all your ErOS data at any time on ErOS's My page. This deletes your chats, the works you made and other people's chats with those works at once, and cannot be undone. Your Ailism account stays.

You can delete a conversation with a mate at any time under My mates on Ailism Mate. This deletes its messages and that mate's memories and diary at once, and cannot be undone.

The age rules for ErOS and Ailism Mate are in Article 5.

Article 13 (User works)

Signed-in users can create and publish works in ErOS Studio, and mates in Ailism Mate's Make a mate. Published works and mates, and the username, display name and profile of the person who made them, are visible to anyone.

The rights to a user work belong to the user who made it.

You allow the Company to store your user works within the services, to show your published works to other users, and to run them so that other users can chat with them and play them, or talk with your mate and keep it in the bottom-right corner of their screen. This license is non-exclusive, free of charge and worldwide.

The license ends when you delete the work, and the Company then removes it at once from public lists and from new chats. It continues, however, for chats other users started before the deletion (until they delete those chats), for the deleted work's content that is kept until you delete your ErOS data or your account (for mates on Ailism Mate, until you delete your account), and for backup copies kept for the period stated in the Privacy Policy.

Use only material you own the rights to or have permission to use in your works. Do not upload others' copyrighted work (such as art or writing) or photos of real people without permission.

When you use "Make with AI" in the Studio, the image prompt and reference pictures from that work are sent to the company that makes the pictures (Higgsfield), which may use them to train its own AI. The same applies when you make pictures with AI in Ailism Mate's Make a mate. Details are in section 3 of the Privacy Policy.

The Company may hide or remove works that break these terms or the law, based on reports or its own review, and may suspend the accounts that made them (Article 14). If you think another user's work breaks these terms, report it with the report feature of ErOS or Ailism Mate or by email.

Article 14 (Restricting use)

If you break these terms or the law, the Company may refuse your requests, restrict or suspend use from your device, connection or account, or hide or delete related results or user works. Where the law was broken, the Company may cooperate with lawful requests from the authorities.

Article 15 (Changing or suspending the services)

The Company may change or suspend all or part of the services for operational or technical reasons and will give notice in advance where possible. The services may stop temporarily for maintenance, outages or problems with outside services (such as the AI companies that make results).

Because the services are free, the Company does not compensate for changes or suspensions unless the law specifically requires it.

Article 16 (Limitation of liability)

Unless caused by its intent or gross negligence, the Company is not liable for:

• losses from causes beyond the Company's control, such as natural disasters, power or network failures, or outages of outside services
• losses caused by the user's own fault or breach of these terms
• losses relating to the content, accuracy or fitness for a particular purpose of results or of the replies and stories the AI writes on ErOS and Ailism Mate, or from using or spreading them
• disputes between a user and other users (including the people who made works or mates) or third parties

This article does not limit any liability of the Company that cannot be limited under applicable law.

If you breach these terms and cause loss to the Company or others, you must compensate for that loss.

Article 17 (Content portal)

Anyone can browse the content portal (Ailism Original). Posting photos, community posts, comments, your own webtoons and shorts ("posts") and pressing like, vote or follow require signing in as an Ailism member with a verified email address. Guest accounts cannot post.

Posts and the poster's username, display name and profile bio are public. Official works posted by the Ailism team are marked "Ailism official", and works posted by members are marked as member works.

Rights in a post stay with the user who posted it. You allow the Company to store your posts in the services, resize and convert them for screens and devices (including list thumbnails and video conversion), show them to other users, and include them in the content portal's lists, rankings, search and home page. This permission is non-exclusive, free and worldwide. It ends when you delete the post, except for the retention period in the Privacy Policy (30 days after deletion) and backup copies.

Only post what you own or have permission to use, and follow the community rules. Illegal intimate images, sexual depictions of minors, edits or imitations of real people, other people's personal information and other people's works used without permission may not be posted. You may post pictures made with generative AI, and you are responsible for any rights issues they raise.

The Company may take down or delete posts that break these terms, the community rules or the law, after a report or its own review, and shows the poster why. Repeated breaches can pause posting on the content portal (Article 14). To prevent spam, each account can post only a limited number of items in a given time.

If someone's post infringes your rights (copyright, portrait rights, personal information), report it with the post's report button or as described in copyright and rights claims.

Article 17-2 (Credits and paid services)

Credits are what AI features (chat, pictures, video, voice, AI panels and the like) cost, taken by their real cost. There are the credits your plan gives each day (today's credits, refilled at 00:00 Korea time) and the credits a member buys or the Company grants (held credits). Today's credits are used first; when they run out, held credits are used, the ones that end first first.

Members who have verified their email can buy credit packs on the credits page of the account centre. Each pack shows the credits, any bonus credits and the price (VAT included) before you buy; payments go through the payment company the Company chooses. Paid credits are added to your held credits at once.

Bought credits can be used for 5 years from payment; credits the Company grants for the period stated when they are granted. Credits left after that end.

Within 7 days of payment, if none of the credits from that payment were used, you may withdraw and get the whole amount back. Once any of them are used, withdrawal for the used part is limited under Article 17(2) of the Act on the Consumer Protection in Electronic Commerce.

Otherwise (after 7 days, or with some used), you get the value of the paid credits from that payment still left (bonus credits count as used first): the amount paid × paid credits left ÷ paid credits bought, less a 10% refund fee (at least ₩1,000). Bonus credits and credits the Company granted are not refunded.

Ask for a refund at ailismcorp@gmail.com with your order number. The Company handles it within 3 business days of the request and returns it to the way you paid; the payment company or card company may take a few more days.

If credits were taken through the Company's fault, or you used credits and got no result, the Company gives those credits back.

If a member under 19 paid without a legal guardian's consent, the member or the guardian may cancel the payment, unless the member pretended to have consent or the payment was within what the guardian allowed.

Deleting your Ailism account ends any held credits left. Ask for any refund before deleting your account.

Article 18 (Contact and notices)

Send questions, reports and rights infringement claims about the services to ailismcorp@gmail.com. Works and AI replies on ErOS can also be reported with ErOS's own report feature, mates and messages on Ailism Mate with Ailism Mate's own report feature, and posts on the content portal with each post's report button. The Company posts notices for all users in the services or on this page.

Article 19 (Governing law and jurisdiction)

These terms and the use of the services are governed by the laws of the Republic of Korea. Disputes about the services are resolved in the court with jurisdiction under the Korean Civil Procedure Act.

Addendum

These terms take effect on October 17, 2026. The articles about the newly added Ailism account and ErOS apply from their publication on October 17, 2026, because they concern new services that people choose to sign up for. The terms for the camera app, its web version and the content portal have not changed; only their article numbers changed when the new articles were added. Future changes will follow the 7-day and 30-day notice in Article 3.

The articles about members posting on the content portal (Articles 4, 5, 17 and 18) take effect on October 21, 2026. They cover a new feature that applies only when signed-in members choose to post; the terms for browsing the content portal have not changed.

The provisions about ratings and adult verification (Article 5) take effect on October 22, 2026. They cover a new feature that opens 18+ works only to members who choose to verify their age; the other terms have not changed.

The provisions about Ailism Mate (Articles 1, 2, 4, 5, 12, 13, 16 and 18) take effect on October 27, 2026. They move the mate, offered until then as an ErOS feature, into its own service Ailism Mate; mates and the mates users make are under the same terms as ErOS characters and works. Because it is a service people choose to use, they apply from its publication; the terms for ErOS, the camera app and its web version, and the content portal have not changed.

The provisions that name the company and its details (the introduction, Articles 1 and 2, the wording of the other articles that names the Company as the party providing the services, and Company information) take effect on October 30, 2026. They name the company that runs the services (hjbrain Co., Ltd.) as the party to these terms; the terms of use and users' rights and obligations have not changed, so they apply from their publication.

The provisions about credits and paid services (Articles 4 and 17-2) take effect on October 30, 2026. They cover a new feature that applies only when members choose to buy credits; the terms for using the daily credits have not changed, so they apply from their publication.

If this translation differs from the Korean terms, the Korean terms prevail.
